Terms and Conditions

ARTICLE I – HOST STANDARDS

1.0 Introduction 1.1 These Host Standards (“Standards”) apply to all individuals and entities (“Hosts”) who list or provide access to any property or play area (“Park”) through Waggly Dog Parks (“Waggly”). 1.2 Hosts agree that compliance with these Standards is a condition of participation. 1.3 Waggly reserves the right to investigate, suspend, limit, or remove any Host or Park that fails to comply.

2.0 Property Eligibility and Control 2.1 Hosts may list only privately owned or legally controlled property. Public or communal areas are prohibited. 2.2 Hosts must ensure exclusive use of the Park during bookings and keep their own animals out of the booked area. 2.3 Hosts must comply with all applicable laws, zoning regulations, lease terms, HOA rules, and insurance requirements.

3.0 Safety and Condition of the Park 3.1 Hosts must maintain the Park in a reasonably safe condition and inspect regularly for hazards. 3.2 Hosts must disclose safety-related features or risks such as water bodies, wildlife, livestock, fencing gaps, or nearby roads. 3.3 Hosts must maintain sanitary conditions and address waste or hazards promptly.

4.0 Listing Accuracy and Transparency 4.1 Listings must include accurate photos and descriptions of size, fencing, terrain, and features. 4.2 Hosts may set reasonable property rules, provided they comply with Waggly policies. 4.3 Listings may not advertise non-Waggly services such as grooming or boarding.

5.0 Calendar Management and Commitments 5.1 Hosts must maintain accurate availability. 5.2 Host cancellations must be for legitimate reasons and processed through Waggly. 5.3 Hosts must ensure access at the scheduled booking time.

6.0 Communication and Responsiveness 6.1 Hosts must use Waggly’s messaging system for all communications. 6.2 Hosts must respond to inquiries within a reasonable period.

7.0 Neighbor and Community Relations 7.1 Hosts must minimize disturbances and comply with noise and nuisance ordinances. 7.2 Parking and entry instructions must be clearly communicated.

8.0 Inclusion and Non-Discrimination 8.1 Hosts may not discriminate based on protected characteristics. 8.2 Reasonable dog-related limitations are permissible if allowed under law.

9.0 Reviews, Ratings, and Enforcement 9.1 Guests may leave reviews; Hosts may not manipulate feedback. 9.2 Waggly may suspend or remove listings that violate safety or policy standards.

ARTICLE II – HOST PARTICIPATION RELEASE & WAIVER

10.0 Assumption of Risk by Host 10.1 Hosting involves inherent risks including property damage and personal injury. 10.2 Hosts voluntarily assume all risks associated with hosting through Waggly.

11.0 Host Responsibility for Property and Compliance 11.1 Hosts are solely responsible for Park condition and compliance with Host Standards. 11.2 Hosts must comply with laws, HOA rules, insurance requirements, and zoning limitations. 11.3 Hosts are responsible for confirming insurance coverage for hosting activities.

12.0 Release of Waggly 12.1 Hosts release Waggly from claims arising out of hosting activities, property condition, or guest interactions, except where prohibited by law. 12.2 This release does not cover Waggly’s intentional misconduct.

13.0 Indemnification 13.1 Hosts must indemnify Waggly against claims arising from: - Violations of these Standards - Violations of law - Injuries or damages on the property caused by hosting activities.

ARTICLE III – COMMUNITY GUIDELINES

14.0 Purpose 14.1 Guidelines apply to all Waggly users, including Hosts and Guests.

15.0 Dogs First 15.1 Users must consider their dog’s unique needs and restrictions. 15.2 Dangerous or legally prohibited dogs may not participate unless legally approved.

16.0 Respect for People and Property 16.1 Hosts must provide safe, clear access. 16.2 Guests must arrive and leave on time, clean up waste, and follow rules.

17.0 Inclusion and Non-Discrimination 17.1 Users must follow all anti-discrimination laws. 17.2 Harassment or discriminatory behavior may lead to removal.

18.0 Honest Communication 18.1 Users must provide accurate information regarding profiles, pets, and listings. 18.2 Misrepresentation of dog behavior or vaccination status is prohibited.

19.0 Good-Faith Resolution 19.1 Users agree to communicate respectfully and seek clarification before conflict escalation.

20.0 Reporting Safety Concerns 20.1 Users must report hazards promptly. 20.2 Retaliation for good-faith reporting is prohibited.

21.0 Prohibited Conduct Prohibited behaviors include: - Illegal activity - Use of Parks under the influence of impairing substances - Leaving dogs unattended - Bringing unauthorized animals - Harassment or abusive communication - Circumventing Waggly fees

ARTICLE IV – GUEST RELEASE, WAIVER & ASSUMPTION OF LIABILITY

22.0 Eligibility and Authority 22.1 Guests must be at least 18 years old. 22.2 Guests take responsibility for minors and confirm authority over each dog brought.

23.0 Compliance with Pet Ownership Laws 23.1 Guests must comply with all licensing, vaccination, and ownership laws. 23.2 Guests may not bring dogs legally designated as dangerous unless legally permitted and approved by Waggly.

24.0 Booking Window and Covered Period 24.1 The “Covered Period” extends from 15 minutes before the booking start to 15 minutes after its end. 24.2 Guests may not remain outside the Covered Period without Host consent. 24.3 All liability and responsibilities apply throughout the Covered Period.

25.0 Assumption of Risk 25.1 Guests accept inherent risks of dog activity, outdoor terrain, environmental hazards, and interactions with other animals. 25.2 Guests voluntarily assume all risks unless prohibited by law.

26.0 Guest Responsibilities 26.1 Guests must supervise dogs and minors. 26.2 Guests must control dogs within permitted areas and obey all Park rules. 26.3 Guests must check for hazards and cease use if necessary.

27.0 Release of Hosts and Waggly 27.1 Guests release Hosts and Waggly from liability for injuries, damages, or losses arising during the Covered Period.

28.0 Property Damage and Dog-Related Incidents 28.1 Guests are responsible for any property damage caused by themselves, dogs, or invitees. 28.2 Guests are legally responsible for any harm caused by their dog.

29.0 Indemnification 29.1 Guests will indemnify Hosts and Waggly for damages arising from violations, negligence, or misconduct.

30.0 Acknowledgment 30.1 Guests confirm they have reviewed and voluntarily agree to this Release & Waiver.
